CardNexus Shield Terms of Service
The terms governing the CardNexus Shield shipping-protection service: subscription, premium, covered events, conditions, exclusions, claims, and indemnification.

Article 1 โ DEFINITIONS
The following definitions apply to these Shield Terms of Service:
"CardNexus": means CardNexus SAS, a company governed by French law with a share capital of 1,909.5 euros, registered with the Bordeaux Trade and Companies Register under number 937 817 674, having its head office at 68 avenue Jules Guesde, Le Bouscat (33110), France.
"Shield": means the optional shipping-protection service offered by CardNexus to Sellers, under which CardNexus provides a contractual guarantee against the Covered Events defined in Article 6 for a given Covered Shipment.
"Seller": means any User selling Products through the Marketplace, as defined in the General Terms and Conditions.
"Order": means a purchase of Products placed by a Buyer with a Seller through the Marketplace.
"Covered Shipment": means a parcel corresponding to an Order for which the Seller has validly subscribed to Shield in accordance with Article 3.
"Covered Amount": means the items subtotal of the Order, in the Seller's listing currency, as displayed at the time of subscription. Shipping costs are not included in the Covered Amount.
"Premium": means the price of Shield for a given Covered Shipment, as defined in Article 4.
"Consignment Date": means the calendar day (local time) on which the parcel is handed over to the carrier.
"High-Value Shipment": means a Covered Shipment whose Covered Amount is equal to or greater than the threshold set out in Article 7.3 for the Seller's listing currency.
"Covered Event": means one of the events listed in Article 6.
"General Terms and Conditions": means the CardNexus General Terms and Conditions available in the help center.
Article 2 โ PURPOSE AND SCOPE
2.1 These Shield Terms of Service govern the subscription, operation, and performance of Shield. They supplement the General Terms and Conditions, which continue to apply to all matters not addressed herein. In the event of a conflict concerning Shield, these Shield Terms of Service prevail.
2.2 Shield is a contractual guarantee granted by CardNexus to the Seller. It is offered on a per-shipment, opt-in basis and creates no obligation for any shipment for which it has not been subscribed. CardNexus maintains its own insurance coverage with a specialist parcel-insurance provider; the Seller's sole counterparty under Shield is CardNexus.
2.3 Shield is available to Sellers shipping from CardNexus's supported marketplace regions, for Orders in the supported listing currencies (EUR, USD, GBP, CAD, CHF, SEK, DKK, NOK, PLN, HUF).
Article 3 โ SUBSCRIPTION
3.1 Shield is subscribed per shipment, in the "Mark as shipped" flow of the Platform (web or mobile application), at the latest on the Consignment Date, by 11:59 PM local time. Shield cannot be subscribed after the Consignment Date.
3.2 Subscription requires the Seller's express acceptance of these Shield Terms of Service and of the attestations presented at subscription, which form conditions of coverage under Article 7.
3.3 At subscription, CardNexus records on the Order the Premium, the Covered Amount, the attestations given, and a technical log (IP address, user agent, timestamp). Subscription is final once the Order is marked as shipped; the Premium is due for the Covered Shipment regardless of whether a Covered Event occurs.
Article 4 โ PREMIUM
4.1 The Premium is equal to one percent (1%) of the Covered Amount, corresponding to an increase of one percentage point of the Commission applicable to the Order. It is computed and locked at subscription, in the Seller's listing currency, and is not affected by subsequent exchange-rate variations. Amounts are rounded up to the nearest cent.
4.2 A minimum Premium per Covered Shipment applies, according to the Seller's listing currency: โฌ0.40 (EUR), $0.45 (USD), ยฃ0.35 (GBP), CA$0.60 (CAD), CHF 0.40 (CHF), 5.00 kr (SEK), 3.00 kr (DKK), 5.00 kr (NOK), 2.00 zล (PLN), 200 Ft (HUF).
4.3 The Premium is deducted from the Seller's payout for the Order at the time funds are released, together with the Commission.
Article 5 โ COVERED AMOUNT AND COVERAGE PERIOD
5.1 CardNexus's total liability under Shield for a Covered Shipment is capped at the Covered Amount. The Covered Amount cannot exceed the items subtotal of the Order; over-insurance is not possible.
5.2 Coverage takes effect upon handover of the parcel to the carrier and expires twenty-one (21) days after the Consignment Date. The Seller must use a shipping service reasonably expected to deliver within this period.
Article 6 โ COVERED EVENTS
Shield covers the following events affecting a Covered Shipment during the coverage period:
Loss: the parcel is lost in transit, as confirmed by the carrier or evidenced by a prolonged absence of carrier movement;
Theft: the parcel is stolen, where the theft is the subject of a police report;
Damage: the Products are delivered damaged as compared to their condition at handover to the carrier, as established in particular by the photographs referred to in Article 7.1;
Non-delivery: the parcel is declared delivered by the carrier but has not been received by the Buyer, as attested by the Buyer's signed statement of non-receipt.
Article 7 โ CONDITIONS OF COVERAGE
7.1 For every Covered Shipment, the Seller must:
before shipping, photograph the contents of the parcel and the closed parcel showing the recipient's address, the shipping label, and the postage;
hand the parcel to the carrier on the Consignment Date declared at subscription;
enter on the Order the tracking number actually affixed to the parcel;
use a tracked shipping service.
7.2 For High-Value Shipments, the Seller must in addition:
use a shipping service with signature on delivery; and
pack the Products in a rigid cardboard box. Envelopes, bubble mailers, and cardboard envelopes do not satisfy this requirement.
7.3 The High-Value Shipment thresholds per listing currency are: โฌ200 (EUR), $230 (USD), ยฃ170 (GBP), CA$300 (CAD), CHF 190 (CHF), 2,300 kr (SEK), 1,500 kr (DKK), 2,300 kr (NOK), 850 zล (PLN), 80,000 Ft (HUF).
7.4 If any condition of this Article 7 is not satisfied for a given shipment, coverage is void for that shipment: Shield does not apply, the parcel is treated as uninsured, and the Premium remains due. The voiding of coverage for one shipment does not affect other Covered Shipments.
Article 8 โ EXCLUSIONS
The following are excluded from coverage:
shipments sent without tracking;
disputes relating to the condition, authenticity, grading, or conformity of the Products, which are governed by the dispute-resolution process of the General Terms and Conditions;
cancellations, returns, and refunds initiated by the Buyer;
purely cosmetic damage, such as superficial scratches or scuffs;
damage pre-existing at handover to the carrier; the condition of the Products at handover, as established by the photographs referred to in Article 7.1 and the condition stated in the listing, serves as the baseline;
shipments to countries or territories subject to international sanctions or embargo, and shipments from or to the African continent;
any shipment for which coverage is void under Article 7.4.
Article 9 โ CLAIMS
9.1 Claims are made by opening a support request from the Order page, within the following time limits:
for Loss or Theft: within twenty-one (21) days of the Consignment Date;
for Damage or Non-delivery: within fourteen (14) days of the delivery date recorded by the carrier.
9.2 The Seller must provide, depending on the Covered Event:
Loss: the carrier's confirmation of loss, which CardNexus may assist in obtaining;
Theft: a copy of the police report and of the identity document of the person who filed it;
Damage: photographs of the damaged Products and of the packaging; where possible, damage noted by the Buyer on the delivery slip at reception; the packaging must be preserved until the claim is resolved;
Non-delivery: the Buyer's signed statement of non-receipt and a copy of the Buyer's identity document.
9.3 CardNexus may request any additional supporting documentation reasonably necessary to assess the claim, including the photographs referred to in Article 7.1, the carrier's scan history, or proof of the declared value.
Article 10 โ INDEMNIFICATION
10.1 Where a claim is accepted, CardNexus indemnifies the Seller up to the Covered Amount. For damaged Products that can be repaired, the indemnity may be limited to the cost of repair, without exceeding the Covered Amount.
10.2 Any compensation received by the Seller from the carrier or any third party for the same event is deducted from the indemnity. The Seller may not recover more than once for the same loss.
10.3 If a parcel indemnified as lost or non-delivered is subsequently found and delivered, the Seller must inform CardNexus and repay the indemnity received, less any covered loss or damage actually suffered.
10.4 Any fraudulent claim results in the refusal of the claim, the definitive loss of the Premium, and may give rise to the measures provided for in the General Terms and Conditions, including suspension or termination of the Account, without prejudice to any legal action.
Article 11 โ MODIFICATION
CardNexus may modify these Shield Terms of Service at any time. The version in force at the time of subscription applies to the Covered Shipment concerned. Modified terms apply only to subscriptions made after their publication.
Article 12 โ LIABILITY
Shield is a contractual guarantee limited to the indemnification described in these Shield Terms of Service. It does not affect the statutory rights of Buyers, nor the Seller's obligations towards Buyers under the General Terms and Conditions and applicable law. CardNexus's aggregate liability under Shield for a given Covered Shipment shall not exceed the Covered Amount.
Article 13 โ GOVERNING LAW AND JURISDICTION
These Shield Terms of Service are governed by and interpreted according to French law. The jurisdiction provisions of the General Terms and Conditions apply. Users acting as consumers retain the benefit of any mandatory protective provisions of the law of their country of residence.
